At this time, it remains unclear when the state will begin to scale back the in-person restrictions now constraining non-essential construction in New York. However, the governor has provided some hints with regard to the broader economy, having tweeted at 1:17 pm today as follows: “As we look ahead, we will operate under one principle: Do No Harm. The gradually phased reopening will be determined by (1) how essential an industry is and (2) what the infection risk is for each industry. The most essential and lowest risk industries will be opened first.”
With this in mind, and with media reporting cautiously pivoting toward the daunting task of sequencing the reopening of the economy without triggering a second wave of infections, please see the attached Bulletin discussing the complex legal and practical issues employers are likely to face when in-person workplace restrictions are lifted, jobsites begin to reopen, and employees are brought back to work.
